ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States (including the District of Columbia) who are 18 years or older at the time of entry and have Internet access. Employees, officers, directors, representatives and shareholders of Microsoft Corporation (“Sponsor”), Be Jane, Inc. (“Be Jane”), Project Support Team, Inc. (“Administrator”), and each of their respective parent companies, subsidiaries, affiliates, assignees, officers, directors, partners, distributors, retailers, agents involved in this Sweepstakes, and advertising/promotion agencies (collectively, the “Released Parties”), and any such individual’s immediate family members (including mother, father, brother, sister, child or spouse, regardless of where they reside) and those living in their households (whether related or not) are not eligible to enter or win. Sweepstakes is void in Puerto Rico and where prohibited.
HOW TO PARTICIPATE: During the period 1/4/07 (12:00:01 PM Pacific Time (“PT”)) to 2/7/07 (11:59:59 PM PT) (the “Promotion Period”), you will receive one Sweepstakes entry when you register online at [URL TBD] (the “Website”) and answer the Be Jane trivia question provided. You need not answer the trivia question correctly to gain a sweepstakes entry, though you must complete all required fields provided on the registration form. Failure to provide complete and accurate registration data will result in automatic disqualification. Limit one entry per person during the Promotion Period. Additional entries beyond the first entry from any one person will be void. The Website's database clock will be the official time keeper for this Sweepstakes. As part of the entry process you may be asked if you would like to opt-in to receive promotional email messages from Be Jane. Opting in to receive these email messages is not required for entry and does not affect your chances of winning a prize. The manner in which your information is used will be governed by the Be Jane Privacy Policy, located at http://www.bejane.com/privacy_policy. In the event of a dispute as to the identity of an entrant based on email address submitted on the online entry form, entry will be deemed to be from the email account subscriber of the email address at issue (provider he/she meets the eligibility requirements), as determined by Sponsor in its discretion regardless of the name that appears on the official on-line entry form. Entries become property of Sponsor and will not be acknowledged or returned. The use of any devices to automate entry, including but not limited to, entries submitted using any bot, macro, script, hack, sweepstakes service or form-filling software (or any other devices intended to automate any part of the entry process) to gain an entry into this Sweepstakes is prohibited. If Administrator or Sponsor, at their sole discretion, determine that any entrant has used any device to automate the entry process, all entries from that entrant will be void and future entry attempts by the entrant at issue may be blocked. Released Parties are not responsible for telephonic, human or computer software or hardware failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, phones, phone lines or telephone systems, traffic congestion on the Internet or at any web site, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise, non-delivery, misdirected, blocked or delayed email notifications, or for typographical, printing or other errors appearing in these rules, the announcement of the prizes or other Sweepstakes-related materials, or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes, or for any other errors or problems of any kind, including, without limitation, errors or problems which may occur in connection with administration of the Sweepstakes or the processing of entries, even if caused by the negligence of any one or more of the Released Parties. Released Parties are also not responsible for incomplete, illegible, unintelligible, inaccurate, lost, misdirected, garbled or mutilated entries or entries containing false information of any kind and all such entries will be disqualified. CAUTION: Any attempt to deliberately damage any web site or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
WINNER SELECTION: One (1) potential Grand Prize winner and (35) potential First Prize winners will be selected on or about 2/14/07 (the “Drawing Date”) by Project Support Team, Inc., an independent judging agency, in one random drawing from among all eligible entries received during the Promotion Period.
PRIZE/ODDS: One (1) Grand Prize and (35) First Prizes (one for each day of the Promotion Period) are available. The Grand Prize consists of a Be Jane autographed book, a Be Jane Pink Pak, a $500 gift certificate to ImprovementDirect.com, a $250 gift certificate to a spa near the winner’s home (to be determined by Be Jane) and a $250 gift certificate to ThePajamaCompany.com (Approximate Retail Value: (“ARV”): $1,080). Each First Prize will consist of a Be Jane autographed book and a Be Jane pink toolbelt (ARV=$55 each). Total ARV of all prizes = $3,005. Odds of winning any prize will depend upon the total number of eligible entries received. All applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of winners. Gift certificates are subject to terms and conditions specified by issuers. Specifics of Grand Prize package are subject to availability and Sponsor’s sole discretion. All prize details are at Sponsor’s discretion. ARV of autographed prize elements is subject to fluctuation based on the current market value at time of prize award. All prizes will be awarded “as is” with no warranty or guarantee either express or implied by the Released Parties. Any and all warranties and/or guarantees on these prizes (if any) shall be subject to the manufacturer's terms therefore, and winner agrees to look solely to such manufacturer for any such warranty and/or guarantee.
MISCELLANEOUS: No transfer, cash redemption or substitution of the prizes (or portion of prizes) by the winners (unless approved in writing by Sponsor) except that Sponsor may at its discretion substitute a prize (or portion of the prize) with a prize of comparable or greater value. Potential winners will be notified by phone, mail and/or email within approximately two (2) weeks following the Drawing Date. If, despite reasonable efforts, the potential winner does not respond within seven (7) business days of the date of issuance of first notification, or if any potential winner is not in compliance with these Official Rules, or if a prize or prize notification is returned as unclaimed or undeliverable, such potential winner will forfeit his or her prize and, at Sponsor’s discretion, an alternate potential winner may be selected. Sponsor will attempt to contact up to three (3) potential Grand Prize winners in accordance with the above procedure, after which the prize at issue may go unawarded if it remains unclaimed. The potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within seven (7) days of date of issuance of notification or prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate winner. By entering, all participants (their parents/legal guardians if residents of a jurisdiction which deems them to be minors) agree to these Official Rules and to the decisions of the Sponsor and judges, which shall be final and binding in all respects, and further agree that 1.) the Sponsor may use (unless prohibited by law or its Privacy Policy) their name, city and state of residence, photograph and/or other likeness for advertising and/or trade and/or any other purpose in any and all media now or hereafter known worldwide in perpetuity without further compensation, permission or notification and 2.) the Released Parties shall have no liability and will be held harmless from any liability, loss, injury or damage to participant or any other person or entity, including personal injury or death to entrant or any other person or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize or participation in this Sweepstakes. Sponsor reserves the right, at its sole discretion, to void suspect entries and/or cancel, terminate, modify or suspend any portion of this Sweepstakes should virus, bugs, non-authorized human intervention, tampering, fraud or other causes corrupt or impair the administration, security, fairness, integrity or proper play of this Sweepstakes and, in any such event, at its discretion, select the winners from all eligible non-suspect entries received prior to the event requiring such action be taken. Entrants waive all claims against the Released Parties for the suspension, modification, termination or cancellation of this Sweepstakes.
