Full Rules

  1. How to Enter: You may enter the Sweepstakes by visiting http://www.bejane.com/ icanfixthat ("Web Site"), and entering on the site by completing and submitting the entry form as directed. Limit one (1) online entry per valid email address, per eligible person. Additional Prize limitations apply to families and households under Section 5 below. Multiple Entries in excess of the stated limit by the same person or from the same e-mail address will be disqualified. Information required for entry (collectively "Entry Information") consists of full name (first and last name), complete address (no P.O. Boxes) and email address, phone number (including area code), gender and date of birth.]. Incomplete or inaccurate online entries are void. In the event of a dispute over the identity of an entrant, the entry will be deemed made by the natural person who, at the time of entry, is assigned to the email address (the "Authorized Account Holder"), according to the Internet service provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. An entry will be deemed submitted by the Authorized Account Holder of the email address at the time of entry. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. Automated, programmed, robotic or mechanically reproduced entries will be disqualified. All online entries must be submitted between 12pm Pacific Daylight Time ("PDT") Wednesday, March 28, 2007 and 12pm PDT Friday, April 30, 2007 (the "Sweepstakes Promotion Period"). One entry per person for the entire Sweepstakes Promotion Period. Once submitted, all online entries become the exclusive property of Be Jane, Inc. ("Sponsor") and will not be acknowledged or returned. Any attempted form of entry into the Sweepstakes other than as described herein is void. Entries that are in violation of these Official Rules will be disqualified.
  2. Official Rules: For these Official Sweepstakes Rules, either (i) send a self-addressed, stamped envelope ("SASE") to Be Jane, Inc. I Can Fix That Sweepstakes "Rules", 218 East Orange Grove Avenue, Burbank, CA 91502; or (ii) visit the http://www.bejane.com Web Site.
  3. Eligibility: The Sweepstakes is open to legal residents of the United States (excluding Rhode Island, Puerto Rico and the U.S. Virgin Islands) and the District of Columbia who are 18 years of age or older as of Wednesday, March 28, 2007; living in the United States or the District of Columbia; and have access to the Internet. Entrants by groups, corporations or organizations are not eligible to enter this Sweepstakes. The following persons are not eligible to participate or win a Prize: Employees and officers and directors of BeJane.com, ImprovementDirect.com, Hilltop New Media, Inc., Sony Pictures Digital Inc., Sony Pictures Entertainment Inc. and their advertising or promotion agencies, those involved in the production, development, implementation or handling of this Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parents, affiliates, and subsidiaries, licensees, service providers, and any other person or entity associated with this Sweepstakes (collectively, the "Sweepstakes Entities"), members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related, are ineligible to enter this Sweepstakes. This Sweepstakes is void outside of the 50 United States and the District of Columbia and wherever prohibited or restricted, and is subject to all federal, state and local laws. Entries originating from any other jurisdiction are not eligible for participation in the Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web Site. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Participation in the Sweepstakes constitutes your full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Sweepstakes. Participants not abiding by these rules may be disqualified. The Sweepstakes may only be entered in or from the 50 United States (excluding Rhode Island) and the District of Columbia.
  4. Winners will each receive a prize ("Prize"), which shall be delivered to U.S. addresses only. There will be a total of one (1) Grand Prize awarded with an Approximate Retail Value ("ARV") totaling $2579 consisting of the following: One (1) Tips & Tricks CD by The Janes of BeJane.com and Be Jane.MSN.com (ARV $9), One (1) Be Jane's Guide to Home Empowerment Book (ARV: $30), One (1) $2500 gift certificate to ImprovementDirect.com (ARV: $2500), ); One (1) Are We Done Yet? merchandise pack consisting of One (1) T-Shirt; One (1) Hat; One Tape Measure Key Ring and One (1) Official movie poster (ARV: $40.00). There will be a total of five (5) First Prizes awarded with an ARV totaling $70 each. Each First Prize consists of the following: One (1) Be Jane's Guide to Home Empowerment book (ARV: $30), and One (1) Are We Done Yet? merchandise pack consisting of One (1) T-Shirt; One (1) Hat; One (1) Tape Measure Key Ring and One (1) Official movie poster (ARV: $40.00) Total ARV of all Prizes awarded in the Sweepstakes: $2929. Prize restrictions may apply. Limit one (1) Prize per person per family and/or household. All costs, taxes, fees and expenses associated with any element of any Prize not specifically addressed herein are the sole responsibility of the Prize Winners. All federal, state and local taxes on a Prize are the Prize Winner's responsibility. The specifics of the Prize shall be solely determined by the Sponsor. Prizes can not be transferred, substituted or redeemed for cash except at Sponsor's sole discretion. Sponsor reserves the right to substitute a Prize, in whole or in part, with a prize of equal or greater value. Any depictions of Prizes are for illustrative purposes only. Odds of winning a Prize depends on the number of eligible entries received.
  5. Drawing and Notification of Winners: On or about the 20th day of May 2007 ("Drawing Date"), Prize Winners will be randomly selected from all eligible entries received. The Sponsor will notify the winners by mail and/or email within approximately one (1) week after the Drawing Date. If a potential winner is notified by email he/she must respond within five (5) business days of notification of winning or an alternate winner may be selected. Decisions with respect to the Prize Winners and other matters pertaining to the Sweepstakes shall be final. If a potential Prize Winner cannot be contacted after reasonable efforts have been made (as determined by Sponsor in its reasonable discretion), if a potential Prize Winner is found to be ineligible, if a potential Prize Winner fails to comply with these Official Sweepstakes Rules or any of the requirements, and/or if any prize or prize notification is returned as undeliverable, that potential Prize Winner will be disqualified and an alternate potential Prize Winner shall be selected from the remaining eligible entries, at Sponsor's sole discretion.
  6. Redemption and Verification: All Prize claims are subject to verification and compliance with these Official Sweepstakes Rules. In the event of noncompliance with these redemption and verification requirements, the Prize will be forfeited and an alternate Prize Winner may be selected by Sponsor or its designated Sweepstakes Administrator.
  7. General Conditions/Termination: The Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in Sponsor's sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner(s) from all salvageable eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.
  8. Privacy and Publicity: Except as provided below, information submitted with an entry will be subject to Sponsor's Privacy Policy and Terms of Service, which are stated on Sponsor's Web Site, http://www.bejane.com. Additionally, if an entrant chooses to opt-in to a specific offer from a participating Sweepstakes Entity, his/her personal information will be subject to that Sweepstakes Entity's privacy policy and terms of service (if applicable) and such entrant agrees to receive additional email communication from that Sweepstakes Entity. Respective privacy policies of Sweepstakes Entities participating in opt-ins will be accessible from Sweepstakes entry page Unless prohibited by law, entry in the Sweepstakes and/or acceptance of a Prize constitutes permission for the to use worldwide and in perpetuity Prize Winner's name, address (city and state), image, likeness, biographical information, voice and/or video for trade, advertising, publicity and promotional purposes in all media now known or hereafter discovered, including without limitation, the World Wide Web (i.e., http://www.bejane.com), television and/or radio, without notice, review, approval or compensation. Prize Winners agree to execute specific consent documents to such use if requested to do so.
  9. Disclaimers/Indemnification: By entering in this Sweepstakes, all entrants ("Participants"), Prize Winners, and their family members, agents, and employees indemnify release and hold harmless Sponsor and each of the Sweepstakes Entities, as well as the respective officers, directors, agents, employees, shareholders and board members of the foregoing entities and all others associated with the development and execution of this Sweepstakes from and against any and all actions, claims, and/or liability with respect to or in any way arising from participation in this Sweepstakes and/or acceptance or use of the Prize(s), including liability for personal injury, death, damages or loss. Sponsor, its respective affiliates, subsidiaries, parent corporation, each of the Sweepstakes Entities, and their respective officers, directors, shareholders, distributors, employees and agents of the Sweepstakes Entities are not responsible for: any incorrect or inaccurate entry information; printing or human error; theft, tampering, destruction or unauthorized access to or alteration of entries; technical malfunctions; failure, omission, interruption, deletion or defect of any telephone networks, computer online systems, computer dating mechanisms, computer equipment, software, or internet service providers; interruption or inability to access the Sweepstakes online entry form, the http://www.bejane.com Web Site, or any online service via the internet due to hardware or software compatibility problems; any injury or damage to entrant's (or any third person's) computer and/or its contents relating to or resulting from participation in this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities; entries or transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any Web site; and entries that are late, lost, incomplete, misdirected, stolen, illegible, or any combination of the foregoing.
  10. Risk of Loss/Warranties/Indemnification: Participants in the Sweepstakes assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/e-mail submitted to Sponsor. Participant agrees to full Official Rules and to decisions of Sponsor, or its designated agent, which are final and legally binding in all respects and further agree that all Prizes are awarded upon the condition that Sweepstakes Entries shall have no liability whatsoever and shall be indemnified, defended and held harmless by Participant for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any Prize, or participation in this Sweepstakes or participation in any Sweepstakes-related activities and further acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY ARE HEREBY DISCLAIMED.
  11. Disputes and Damages. As a condition of entering the Sweepstakes, Participants hereby agree to the full extent allowed by law that (1) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action and shall be brought in a court of competent jurisdiction in Los Angeles, California; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees.
  12. Publicity Releases. Winners may be required to sign and return an Affidavit of Eligibility/Liability and Publicity Release (where legal) within time specified by Sponsor.
  13. Limitation of Liability: In no event will Sponsor or the Sweepstakes Entities be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of access to and use of the Web Site, http://www.bejane.com, or the downloading from and/or printing material downloaded from said Web Site. Without limiting the foregoing, everything on the Web Site and all Prizes are provided "AS IS" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusion or liability for incidental or consequential damages or exclusion of implied warranties, therefore, some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these limitations or exclusions.
  14. Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of entrant, Sponsor and/or Sweepstakes Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine.
  15. Names of Winners: On or about June 1, 2007, the names of the Prize Winners may be obtained by mailing a SASE to: I Can Fix That Sweepstakes "Winners Names", 218 East Orange Grove Avenue, Burbank, CA 91502. Requests postmarked after July 3, 2007 will not be honored.

Legal Warning: Any attempt by an individual, whether or not an entrant, to damage, destroy, tamper with or vandalize this Web Site or the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws. Be Jane, Inc., reserves the right to seek any and all remedies and damages (including Attorneys' fees) against such individual to the fullest extent permitted by law and in equity.
